Welcome to LowTox.Group! These Terms of Service (“Terms”) govern your access to and use of the LowTox.Group website, progressive web app, AI scanning service, and related content (collectively, the “Service”), operated by LowTox.Group (“we”, “our”, or “us”).

PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN SIGNIFICANT DISCLAIMERS OF LIABILITY, A MEDICAL DISCLAIMER, AND A BINDING ASSUMPTION OF RISK. BY USING THE SERVICE, YOU AGREE TO THESE TERMS.

1. Acceptance of Terms

By accessing or using the Service, creating an account, or scanning a product, you explicitly agree to comply with these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must immediately cease all use of our Service.

2. Nature of the Service (Not a Medical Tool)

Our scanning service allows you to photograph a product label for AI-driven ingredient analysis. The toxicity scores, ingredient breakdowns, and safe swap recommendations provided are strictly for general informational and educational purposes only.

LowTox.Group is an AI-powered aggregator of publicly available data. We do not guarantee the completeness, accuracy, or real-time validity of any scan, score, or recommendation. You acknowledge that AI technology is prone to errors, omissions, and “hallucinations,” and the Service must never be trusted as a definitive safety guide.

3. STRICT MEDICAL DISCLAIMER

LOWTOX.GROUP DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. THE SERVICE IS NOT A SOURCE OF MEDICAL TRUTH.

The sole intended purpose of the information provided by LowTox.Group is to assist you in preparing for discussions with a licensed medical professional, healthcare provider, or dermatologist.

By using this Service, you explicitly agree to the following:

  • Mandatory Consultation: You will review any and all information, toxicity scores, and “safe swap” recommendations generated by the Service with a qualified medical professional before taking any action, changing your skincare routine, discarding products, or making purchasing decisions.
  • No Reliance: You will never use the Service to diagnose, treat, cure, or prevent any disease, skin condition, hormonal imbalance, or health issue.
  • Never Delay Treatment: You will never disregard professional medical advice or delay seeking it because of something you have read, scanned, or received through LowTox.Group.

4. Total Assumption of Risk

By using the Service, you expressly acknowledge and agree that you assume 100% of the risk associated with your use of the platform. You acknowledge that individuals react differently to different ingredients, including those marked as “Safe” or “Approved” by our Service. You agree that LowTox.Group bears zero responsibility for any allergic reactions, chemical burns, hormonal disruptions, adverse health effects, injuries, or damages resulting from your failure to verify our information with a doctor.

5. Limitation of Liability (Zero Liability for Damages)

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LOWTOX.GROUP, ITS FOUNDERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL UNDER NO CIRCUMSTANCES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES CAUSAL TO YOUR USE OF THE SITE OR ITS CONTENT.

This absolute limitation of liability includes, but is not limited to:

  • Any physical, mental, or bodily injury, allergic reaction, or health complication resulting from purchasing or using a product recommended by the Service as a “Safe Swap.”
  • Any harm or damages resulting from discontinuing the use of a product flagged by the Service.
  • Any financial loss from purchasing new products, discarding old products, or medical bills incurred.
  • Any errors, inaccuracies, or omissions in the AI-generated toxicity scores or ingredient breakdowns.

In no event shall LowTox.Group’s total cumulative liability to you for all claims arising out of or relating to the Service exceed the amount you have paid to LowTox.Group in the twelve (12) months immediately preceding the event giving rise to the claim, or AUD $100.00, whichever is greater.

6. Indemnification

You agree to fully indemnify, defend, and hold harmless LowTox.Group and its founders, affiliates, and connected parties from and against any and all claims, demands, lawsuits, damages, losses, costs, liabilities, and expenses (including reasonable legal fees) arising out of:

  • Your use of, or reliance on, any information, toxicity scores, or safe swap recommendations provided by the Service.
  • Any health decisions, product purchases, or lifestyle changes you make without first consulting a licensed medical professional.
  • Any claim by a third party (including family members or dependents) arising from products you purchased or used based on our Service’s recommendations.
  • Your violation of these Terms.

7. Use of the Service & User Conduct

You may use the Service only for lawful purposes. You agree not to:

  • Attempt to reverse-engineer or extract our AI ingredient analysis algorithms, prompts, or proprietary database.
  • Scrape, crawl, or automate the extraction of data from the Service.
  • Impersonate any person or entity or falsely represent your affiliation with any person or entity.

8. User Accounts, Subscriptions, and Billing

To access premium features (such as The Daily Shield or The Total Sanctuary), you must create an account and subscribe to a plan. Paid plans are billed monthly. You may cancel your subscription at any time from your account dashboard. Cancellations take effect at the end of the current billing period. Refunds are strictly provided at our sole discretion.

9. Content Ownership

All content on the website and app, including text, images, UI design, ingredient data structures, toxicity scoring methodologies, and other materials, is owned by LowTox.Group or its licensors. You may not use, reproduce, or distribute any content without prior written permission.

10. Termination of Access

We reserve the right to suspend or terminate your access to the Service, or ban your account, at our sole discretion, without notice or liability, for any reason whatsoever, including violation of these Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New South Wales, Australia, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms will be resolved exclusively in the state or federal courts located in New South Wales.

12. Changes to Terms

We reserve the right to modify or update these Terms at any time. Any changes will be posted on this page with the updated effective date. Your continued use of the Service after any changes constitutes your explicit acceptance of the updated Terms.
